Terms of Service & End User License Agreement

These Terms of Service and End User License Agreement (collectively, the “Terms”) govern your use of the ProtectKit Windows application, ProtectKit Free, ProtectKit Premium, the ProtectKit website, customer support, and related ProtectKit services.

By downloading, installing, purchasing, accessing, or using ProtectKit, you agree to these Terms. If you do not agree to these Terms, do not install, purchase, access, or use ProtectKit.

Important security notice: ProtectKit is designed to complement Windows security technologies and help users inspect, configure, investigate, monitor, maintain, and understand their Windows computer. ProtectKit does not replace Microsoft Defender and does not guarantee that a computer is free from malware, spyware, ransomware, unauthorized access, data loss, or other security threats.

1. About ProtectKit

ProtectKit is a Windows security, privacy, investigation, monitoring, system-protection, and maintenance application designed to make important Windows security information and tools easier to inspect, understand, and use.

ProtectKit may provide access to or information about Windows security technologies and system functions including Microsoft Defender, Windows Firewall, firewall rules, DNS configuration, Windows hardening settings, network connections, services, startup programs, connected devices, security monitoring, system maintenance, repair, recovery, logs, reports, and other supported features.

2. License Grant

Subject to these Terms, ProtectKit grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use ProtectKit for lawful personal or internal business purposes on compatible Windows devices that you own, control, or are otherwise authorized to administer.

ProtectKit is licensed, not sold. Except for the limited license expressly granted in these Terms, ProtectKit and its licensors retain all rights, title, and interest in and to the application, software, design, branding, documentation, website content, and related intellectual property.

3. ProtectKit Free

ProtectKit Free provides access to supported Free features without requiring a ProtectKit Premium subscription.

ProtectKit Free is not represented as a time-limited trial. ProtectKit may, however, modify, add, remove, replace, or reorganize Free features in future versions as the product evolves.

Some ProtectKit pages may display information about Premium functionality even when the active functionality itself requires ProtectKit Premium.

4. ProtectKit Premium

ProtectKit Premium provides access to additional supported features that may include continuous monitoring, real-time alerts, advanced investigation, advanced hardening, expanded history, and additional security or protection functionality.

Premium functionality requires a valid qualifying ProtectKit Premium entitlement. Internet access may be required to purchase, activate, validate, renew, or manage Premium access.

ProtectKit may change the Premium feature set over time as features are improved, replaced, added, removed, or reorganized. Material changes will be handled in accordance with applicable law and any applicable purchase terms.

5. Monthly and Yearly Subscriptions

ProtectKit Premium may be offered through monthly and yearly subscription plans. Unless otherwise clearly stated at the time of purchase, a subscription automatically renews for successive periods corresponding to the selected billing interval until it is cancelled.

The price, billing interval, taxes, and other transaction details shown during checkout control the purchase. Prices may change for future billing periods where permitted by law and subject to any notice or consent requirements that apply.

Cancelling a subscription ordinarily stops future renewal. Access may continue until the end of the already-paid billing period, subject to the applicable payment provider's terms and the status of the subscription.

6. Lemon Squeezy and Payment Processing

ProtectKit currently uses Lemon Squeezy for ProtectKit Premium commerce and related payment or subscription functions.

When ProtectKit Premium is purchased through Lemon Squeezy, Lemon Squeezy acts as the merchant of record for the transaction and provides merchant services associated with the purchase. ProtectKit remains the supplier and licensor of the ProtectKit software.

Purchases processed by Lemon Squeezy are also subject to Lemon Squeezy's applicable buyer terms, payment processes, tax handling, refund processes, subscription rules, and privacy practices.

ProtectKit does not directly process or store complete payment-card information when the transaction is handled by the applicable third-party payment provider.

7. Cancellation

You may cancel a ProtectKit Premium subscription through the subscription management method made available for your purchase or by following the applicable payment provider's cancellation process.

Cancellation generally takes effect for future renewal. Unless required otherwise by applicable law or the payment provider's applicable terms, cancelling does not necessarily create a refund for the unused portion of a current subscription period.

Users should cancel sufficiently before the next renewal date to allow the cancellation to be processed under the payment provider's applicable rules.

8. Refunds

Refund requests for purchases processed through Lemon Squeezy are subject to Lemon Squeezy's applicable buyer terms, refund policies, legal obligations, and case-by-case review.

Nothing in these Terms limits any refund, cancellation, withdrawal, warranty, or consumer right that cannot lawfully be excluded or limited under applicable law.

9. Microsoft Store Distribution

ProtectKit may be distributed through the Microsoft Store. Your use of the Microsoft Store and its installation, update, account, or distribution services is also subject to Microsoft's applicable terms and policies.

Microsoft is not the developer of ProtectKit merely because ProtectKit is distributed through the Microsoft Store. ProtectKit is responsible for the ProtectKit application and its own support except where applicable Microsoft terms provide otherwise.

10. System Changes and Administrator Privileges

Some ProtectKit features can request or initiate changes to Windows settings, security configuration, firewall rules, DNS settings, services, startup configuration, maintenance functions, repair operations, or other system components.

Certain operations require administrator privileges because Windows restricts access to security-sensitive or system-level functionality. You are responsible for deciding whether to authorize an elevated operation.

Before making significant system changes, you should understand the proposed action and maintain appropriate backups or recovery options. Where appropriate, consider creating a Windows restore point before changing system configuration.

11. Security Findings and Investigation Results

ProtectKit may classify, score, describe, or flag security settings, processes, services, connections, startup entries, files, devices, behaviors, or other system information.

A finding described as suspicious, unknown, needs attention, inconclusive, or similar language is not necessarily proof that malware, spyware, unauthorized access, or another threat is present.

Security analysis can produce false positives, false negatives, incomplete results, unavailable results, or results affected by changes in Windows, third-party software, network conditions, permissions, security products, external data sources, or other technical factors.

You are responsible for reviewing available evidence and using reasonable judgment before deleting files, disabling services, blocking connections, changing security settings, or taking other potentially disruptive actions.

12. No Guarantee of Detection or Protection

ProtectKit does not guarantee detection, prevention, identification, blocking, removal, recovery from, or protection against every malicious program, intrusion, spyware application, stalkerware application, ransomware event, malicious connection, security vulnerability, attack, data-loss event, or other threat.

Threats and software change continuously, and no security product can provide complete security. ProtectKit should be used as one part of a broader security approach that includes supported Windows security technologies, software updates, appropriate backups, safe account practices, and reasonable user judgment.

13. Microsoft Defender and Other Windows Technologies

ProtectKit is designed to complement security technologies built into Windows. It does not claim to replace Microsoft Defender, Windows Firewall, Windows Security, or other Microsoft security components.

Features that initiate or display information from Microsoft Defender, Windows Firewall, Windows servicing, system repair, or other Windows technologies depend on those Windows components. Their operation, availability, results, and errors may therefore be affected by Windows itself and are not entirely controlled by ProtectKit.

14. Maintenance, Repair, Optimization, and Recovery

ProtectKit may provide guided access to Windows maintenance, cleanup, repair, optimization, restore, or recovery functionality.

ProtectKit does not guarantee that a maintenance operation will improve performance, repair every Windows problem, recover lost data, or produce a particular performance result.

Some Windows maintenance or repair operations can take significant time and should not be interrupted after they have begun. You are responsible for saving open work and maintaining appropriate backups before performing operations that could affect system configuration or data.

15. Optional Third-Party Services

ProtectKit may provide optional integrations or links to third-party services for reputation checks, security investigation, domain or network registration information, payments, licensing, affiliate administration, or other functionality.

Third-party services are controlled by their respective providers and are subject to their own terms, privacy policies, availability, limits, and data practices.

ProtectKit does not guarantee the accuracy, availability, completeness, or continued operation of third-party information or services.

16. Internet Requirements

Many ProtectKit functions can operate using local Windows information. Other features require internet access, including certain reputation checks, investigation lookups, Premium purchase or validation, subscription management, external websites, or support functionality.

ProtectKit is not responsible for internet outages, provider outages, third-party rate limits, blocked connections, DNS failures, firewall restrictions, or other conditions outside ProtectKit's reasonable control.

17. Acceptable Use

You agree to use ProtectKit only for lawful purposes.

You may not use ProtectKit to:

Access, monitor, interfere with, or administer a computer or network without authorization.
Violate another person's privacy or legal rights.
Facilitate malware, unauthorized surveillance, credential theft, fraud, abuse, or other unlawful activity.
Bypass or defeat licensing, access-control, payment, or security mechanisms.
Misrepresent ProtectKit findings as proof of wrongdoing when the available evidence does not support that conclusion.
Use ProtectKit in a manner that violates applicable law or the rights of another person or organization.

18. Restrictions

Except where applicable law expressly gives you a right that cannot be waived, you may not:

Copy, redistribute, sell, rent, lease, sublicense, or commercially exploit ProtectKit except as expressly authorized.
Reverse engineer, decompile, disassemble, or attempt to derive ProtectKit source code except to the limited extent such restriction is prohibited by applicable law.
Remove or alter copyright, trademark, attribution, or proprietary notices.
Modify ProtectKit for redistribution or create an unauthorized derivative version of ProtectKit.
Use another person's Premium entitlement without authorization.
Share, transfer, forge, manipulate, or circumvent licensing or entitlement information.
Use automated or abusive methods to interfere with ProtectKit services or associated infrastructure.

19. ProtectKit Affiliate Program

ProtectKit may operate an affiliate program through Lemon Squeezy. Participation in the affiliate program is separate from ordinary use of the ProtectKit application and may be subject to additional ProtectKit affiliate rules and Lemon Squeezy's applicable affiliate terms.

Affiliates must accurately represent ProtectKit, clearly disclose material affiliate relationships where required, and must not use fake malware warnings, invented infections, deceptive security claims, spam, or other misleading promotional practices.

ProtectKit may reject, suspend, or terminate affiliate participation for fraud, abuse, misleading advertising, policy violations, or other conduct that ProtectKit reasonably determines could harm users, ProtectKit, or the integrity of the affiliate program, subject to applicable platform rules and law.

20. Updates and Changes to ProtectKit

ProtectKit may release updates that fix bugs, improve security, modify functionality, add or remove features, improve compatibility, update detection logic, or otherwise change the application.

Some updates may be distributed through the Microsoft Store or other authorized distribution mechanisms. Continued use of outdated versions may result in reduced functionality, incompatibility, inaccurate information, or loss of access to online services.

21. Availability

ProtectKit strives to provide reliable software and services but does not guarantee uninterrupted or error-free availability.

Features may be temporarily unavailable because of maintenance, software updates, Windows changes, external-provider outages, network problems, security incidents, legal requirements, technical limitations, or events outside ProtectKit's reasonable control.

22. Intellectual Property

ProtectKit, its original software, user-interface elements, branding, logos, website content, documentation, and other original materials are protected by applicable intellectual-property laws.

Microsoft, Windows, Microsoft Defender, Microsoft Store, and other third-party names, trademarks, products, and services are the property of their respective owners. References to third-party products do not imply ownership by or endorsement of ProtectKit unless expressly stated.

23. User Feedback

You may voluntarily provide suggestions, ideas, bug reports, feature requests, or other feedback about ProtectKit.

By providing feedback, you permit ProtectKit to use that feedback for purposes such as improving, developing, supporting, documenting, or promoting ProtectKit without an obligation to compensate you for the feedback, provided that ProtectKit's handling of personal information remains subject to the Privacy Policy.

24. Privacy

ProtectKit's handling of personal information is described in the ProtectKit Privacy Policy, which is incorporated into these Terms by reference where permitted by applicable law.

25. Suspension and Termination

ProtectKit may suspend or terminate access to ProtectKit-controlled online services or Premium functionality when reasonably necessary because of fraud, abuse, unauthorized access, licensing circumvention, security risk, violation of these Terms, legal requirements, or discontinuation of the applicable service.

Termination of a license or service does not eliminate payment obligations or other obligations that arose before termination, except where applicable law or applicable payment-provider terms require otherwise.

26. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PROTECTKIT AND RELATED SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, OR ERROR-FREE OPERATION.

PROTECTKIT DOES NOT WARRANT THAT THE SOFTWARE WILL IDENTIFY EVERY THREAT, PREVENT EVERY ATTACK, CORRECT EVERY WINDOWS PROBLEM, OR OPERATE WITHOUT INTERRUPTION OR ERROR.

Some jurisdictions do not allow certain warranty exclusions, so some of the exclusions above may not apply to you.

27. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PROTECTKIT, ITS OWNER, CONTRIBUTORS, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, REVENUE, BUSINESS, GOODWILL, OR SECURITY, ARISING OUT OF OR RELATED TO PROTECTKIT OR THESE TERMS, EVEN IF ADVISED THAT SUCH DAMAGES MAY BE POSSIBLE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PROTECTKIT'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO PROTECTKIT OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID DIRECTLY FOR PROTECTKIT PREMIUM DURING THE TWELVE MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR US $50.

The limitations in this section do not apply to liability that cannot legally be excluded or limited under applicable law.

28. Consumer Rights

These Terms are not intended to waive or restrict any mandatory consumer rights, statutory warranties, remedies, withdrawal rights, refund rights, or other protections that cannot lawfully be waived or restricted.

If a provision of these Terms conflicts with a mandatory law applicable to you, that mandatory law controls to the extent of the conflict.

29. Governing Law

To the extent permitted by applicable law, these Terms and disputes relating to ProtectKit are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to conflict-of-law principles.

Mandatory consumer-protection laws applicable in your place of residence may provide additional rights and may affect the law or forum applicable to a particular dispute.

30. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law or modified as necessary to make it enforceable, and the remaining provisions will continue in effect.

31. No Waiver

ProtectKit's failure to enforce a provision of these Terms does not waive the right to enforce that provision or any other provision later.

32. Entire Agreement

These Terms, together with the ProtectKit Privacy Policy and any additional terms expressly presented for a particular ProtectKit service or purchase, constitute the agreement between you and ProtectKit concerning the subject matter covered by those documents.

Third-party services, including Lemon Squeezy and Microsoft Store services, remain subject to their own separate terms.

33. Changes to These Terms

ProtectKit may update these Terms as the application, Premium services, payment arrangements, affiliate program, third-party integrations, distribution methods, or legal and operational requirements change.

The updated Terms will be published with a revised effective date. Where required by applicable law, additional notice or consent will be provided before material changes take effect.
